NEWSLETTER TERMS & CONDITIONS

The Newsletter Terms & Conditions (hereinafter: “T&C”) constitute the fulfillment of the obligation indicated in art. 8, sec. 1, point 1 of the Act of 18 July 2002 on the provision of services by electronic means (Journal of Laws of 2019, item 123, i.e., as amended).

§ 1. General provisions

1. The T&C specify the rules for providing the Newsletter Service by the University of Economics and Human Sciences in Warsaw, address: Warsaw 01-043, ul. Okopowa 59 (hereinafter: “Service Provider”) by electronic means (hereinafter: “Service”), activation and deactivation of the Service and the procedure for complaints against persons using the Services (hereinafter: “Users”, and each individual “User”).
2. The Service Provider provides the Services electronically in accordance with the T&C through the website podyplomowe.vizja.pl (hereinafter: “Portal”).
3 The T&C are made available free of charge on the Portal in a form that allows its acquisition, reproduction, and recording. Anyone can get acquainted with the T&C. By accepting the T&C, the User enters into an agreement for the provision of Newsletter Service by the Service Provider.
4. The user accepts all provisions of the T&C
5. It is forbidden for the User to provide content of an unlawful nature, in particular, to provide other people’s data without their consent.

§ 2. Type and scope of services covered by the T&C

The Service Provider provides by electronic means the Service consisting of sending information containing educational content, including content of a commercial nature, in particular concerning the offer of products and services provided in the form of an electronic letter via e-mail to the e-mail address provided by the User (hereinafter: “Newsletter”). The Newsletter Service is provided free of charge for an indefinite period of time.

§ 3. Terms of Service

1. Newsletter contains informational, promotional or advertising content of the Service Provider. Images and content of the Newsletter Service are subject to copyright or other rights vested in the Service Provider or third parties and are protected by law. Any copying, modification and use of them in a manner inconsistent with their intended use and/or without the consent of the Service Provider may constitute a violation of the law.
2. The user is responsible for the validity of the personal data he indicated in the form.
3. Use of the Newsletter Service is voluntary and does not have a limited period.
4. In order to activate the Newsletter Service, you must:
a) use a device that has access to the Internet with an installed and properly configured, up-to-date version of a web browser,
b) place an order by providing your e-mail address in the electronic form available on the Portal,
c) become familiar with the T&C,
d) press the “Subscribe to Newsletter” button,
e) have an active e-mail address.
5. The User may deactivate the Newsletter Service at any time, which is equivalent to immediate termination of the Newsletter Service Agreement.
6. To deactivate the Newsletter Service, press the “Unsubscribe from Newsletter” button on the Portal.
7. Deactivation of the Newsletter Service may also occur at the initiative of the Administrator, in case of the User’s failure to comply with the obligations required by the T&C.
8. Upon deactivation of the Newsletter Service, the Service Provider shall cease sending the Newsletter to the User’s e-mail address.
9. The User may re-order the Newsletter Service at any time.

§ 4. Complaint procedure

1. The User using the Service has the right to submit complaints regarding the Service to: rektorat@vizja.pl;
2. The complaint should include:
a) contact details of the person making the complaint, necessary to respond to the complaint,
b) a description of what the irregularities in the Service consisted of, and expectations of the settlement.
3. Complaints will be processed immediately upon receipt by the Service Provider. The Service Provider will immediately notify the complainant of the decision on the complaint by e-mail to the e-mail address provided in the application or by registered mail to the address indicated in the complaint.

§ 5 Information on personal data protection

1. The Controller of the personal data is the University of Economics and Human Sciences in Warsaw, address: Warsaw 01-043, ul. Okopowa 59, e-mail address: rektorat@vizja.pl;
2. Personal data will be processed for purposes related to the performance of the contract for the provision of electronic services (legal basis for the processing of personal data art. 6, sec. 1, letter b of the GDPR).
3. Personal data will be processed for purposes arising from the legitimate interest pursued by the administrator in being able to conduct correspondence on the basis of art. 6, sec. 1, letter b of the GDPR.
4. Personal data will be stored during the period of exchange of correspondence, and after that time may be processed and stored for the period of limitation of possible claims.
5. Users have:
a) the right to access their personal data,
b) the right to rectify their personal data,
c) the right to restrict the processing of personal data, subject to the cases referred to in art. 18, sec. 2 of the GDPR,
d) the right to delete data;
e) the right to object to the processing of data due to your particular situation,
f) the right to revoke consent at any time,
g) the right to lodge a complaint with the Polish Data Protection Commissioner.
6. Provision of data is voluntary. Nevertheless, without it, it is not possible to provide the newsletter.

§ 6 Amendments to the T&C

The T&C may be updated to adapt to changes in generally applicable laws or changes in the Service offered.

§ 7. Final provisions

1. In matters not covered by these T&C, the relevant provisions of the Civil Code and the Act on Provision of Electronic Services shall apply.
2. Any disputes will be settled by the common court having jurisdiction over the seat of the University of Economics and Human Sciences in Warsaw.
3. The T&C enter into force on the date of their publication.
